Finding Fault in a Car Accident Personal Injury Case

Since we?re in the business of providing lawsuit loans for car accident cases, we come across many questions and concerns of plaintiffs.? Understanding who is at fault is one of the basic requirements prior to filing a personal injury case in court.

Know the Rules of the Road

Proving who is at fault in a car accident personal injury case can be somewhat complicated, but usually the fault is found with whichever driver is the most careless. It is typically easy to simply say another driver is at fault, based on how you understand the incident occurred. But, it?s far different to figure out who is legally at fault.? To file a personal injury car accident in court you need to know the law, and how the law relates to your particular incident.

Since most of us don?t know every law and how that law relates to each situation, it?s a good idea to seek professional help when trying to understand these confusing issues.? If you suffered a personal injury at the fault of someone else, find a personal injury attorney who can advise you and protect your rights.? The lawyer can determine if a case should be filed in court, and also help you with documentation for a car accident lawsuit loan.

Who Is At Fault?

If a driver is in a car accident was less careful than another driver, the driver who is less careful, or more careless, is responsible for a portion of the damages sustained by the driver who is more careful.

If one driver involved in a car accident was less careful than another, the less careful driver must pay for at least a portion of the damages suffered by the more careful one. In most cases common sense will tell you who is at fault, but it all depends on the laws violated.? To prove negligence it?s important to have official documentation to support your claim.

Finding and consulting a reputable personal injury lawyer is one of the best ways to understand the law, and also understand what laws pertain to your case.

Get Copies of the Official Police Report

If law enforcement came to the car accident scene, they are required to report the accident and all the relevant details in an official police report. You will need to request a copy of the official police report from the traffic department of your police department.? In some situations the report gives the officers opinion on who is at fault, and it may even state the officer gave a ticket to a driver.? Regardless of the details, or how the report was written, this report can serve to support your claims.

?Traffic Laws in Your State

It?s also important to understand the traffic laws in the state where the accident occurred. This vehicle code is sometimes referred to as the ?rules of the road? and clearly state based on the statutes of the location what the laws are.? A good lawyer can decipher the laws for you and explain in clear language how they relate to your particular situation.

Once you?ve filed a car accident personal injury lawsuit, it?s time to consider your financial situation and how you?ll find enough money to get by until your case settles.? Court cases can take far longer than you anticipate, so reviewing your financial situation early and finding help can help save you big headaches later.

Facebook sneezes - but more Korean tech firms avoid cold (2012/05/27)

'The Facebook listing could actually give NHN's business portfolio a boost'. - analyst

When Yahoo's stock nosedived 11 percent one day in September 2006 amid forecasts of lower earnings results, shares of Korean tech enterprises such as Daum Communications and Neowiz on the secondary Kosdaq also shed up to 3.1 percent.

Six years later, the connection between U.S. tech shares and their Korean counterparts seems to have weakened. Friday's highly anticipated Facebook IPO is a case in point.

As its shares tumbled 11 percent on Monday, and another 8.9 percent Tuesday, to end at $31, 18 percent below their offering price, shares of NHN, which operates Korea's top portal site Naver, seemed unaffected.

The company has been cited as potentially the biggest beneficiary of Facebook's debut on the stock market, but its shares closed 0.4 percent higher at 230,000 won ($196) yesterday after also climbing Monday.

Kiwoom Securities analyst Ahn Jae-min said this was largely due to investors seeking safe havens amid instability in the Korean stock market, which has suffered from the revived debt crisis in the euro zone. The Kospi recorded a five-month low last Friday as it slumped below 1,800.

"Korean firms were affected by Yahoo in 2006 as profit-making through Internet advertizing was still in its infancy, and it was hard to foresee if search firms could actually make money from this channel", he said.

"We have long since passed that phase, however, and Daum and NHN are actually ahead of Facebook in the sense that Korean companies have established solid Internet advertizing models, while Facebook is still searching for one".

A number of other Korean tech firms that were expected to be affected by Facebook's listing performed poorly yesterday. But that was mainly because the Kospi dropped 20.07 points, or 1.1 percent, to finish at 1,808.62. The Kosdaq retreated 1.2 percent to 455.9.

On the Kosdaq, Daum Communications, the nation's second-largest portal site operator, edged down 0.9 percent to end at 106,500 won, and Neowiz Internet, which runs the Bugs music streaming timeline app on Facebook, tumbled 3.9 percent to 16,000 won.

Neowiz fell as its Q1 earnings guidelines, which were revealed on Tuesday, indicated a net loss of 250 million won. But analysts remain optimistic about the longer-term influence of Facebook's IPO.

"The Facebook listing could actually give NHN's business portfolio a boost, given their similarities in such areas as mobile social networking services and games", said Kim Seok-min, an analyst at Hyundai Securities.

"Facebook could be seen as a rival to Korean Internet enterprises, but the level of threat it poses is not high. Rather, it is likely to help increase their value", said Kim Jin-gu, an analyst with NH Nonghyup Investments Securities.

The PocketGamer.biz Mobile Gaming Mavens on whether consoles ...

The PocketGamer.biz Mobile Gaming Mavens on whether consoles can combat smartphones at E3

The PocketGamer.biz Mobile Mavens is our panel of experts drawn from all sectors of the mobile gaming industry.

The proximity of E3 in Los Angeles and WWDC 2012 in San Francisco means the console versus smartphones battle ? one Nintendo refuse to admit exists ? is likely to heat up.

With E3 up first, we asked the Mavens:

What do Microsoft, Sony and Nintendo need to unveil at E3 to halt the shift away from consoles towards smartphones? And is talk of a subscription-based Xbox 360 a sign that lessons have already been learned?

Jon Hare, Tower Studios
Microsoft needs to wow us with its Windows 8 tablet and - I'm assuming - its connectivity to TV, internet and phones.

Sony and Nintendo need to sell up to Microsoft and Apple, because - in the long term - consoles have had their day.

Let's hope the smartphone market doesn?t turn into the mobile games market over time. I dream of a new tablet market more like the home computer market - now that was an era when developers could really make more money, more easily.

Oscar Clark, PapayaMobile
I essentially agree, but we are still a market in transition.

Consoles once offered a way to package hardcore games experiences which could wow you in a simple way, and created a dedicated engaging mode of play which takes over your living room.

The mode of use is still valid, but it has created a premium gaming ghetto that serves neither the player nor the game developers and restricts creativity. There is no coincidence that on browser and smartphones, the introduction of socialised freemium games has completely upended the market vastly increasing its audience.

Sony is the only one that experimented with changing its mindset with PlayStation Home's freemium approach, which despite its flaws, has created a fertile environment for players and developers to create new ways to play on the console in a way only possible with a walled-garden.

But this in itself won't be enough to save the console as we know it because we live in a connected world and the console doesn't play nice - technically and commercially - with the other devices we all have. That means we can't address players consistently on their terms, where and when and how they want to play our gaming brand.

I'm not advocating a one-size fits all games, but I am suggesting that we need a way to use the cloud to create experiences we can share on different platforms with specific experiences within that game designed to make the most of the devices we want to use, the mode of use of play

Platforms need to free themselves of the shackles of the hardware and instead use to cloud to enable experiences that can address all our devices; our tablets, smart TVs and smartphones.

To find ways to simplify that connected open experience which will delight and tantalise us whatever mood we happen to be in. And of course if we put the value in the cloud the impact of piracy essentially diminishes.

I believe the console platforms have to learn from the experience of social freemium games. The premium model at $60 for triple-A releases can only sustain a very small range of games that are able of creating the anticipation to get past that payment barrier.

That lack of choice will continue to stagnate the market. However, moving to a more open, social, freemium model will be a painful transition and one I think the big players are unlikely to embrace.

John Ozimek, Dimoso
Lots of sense in what Oscar says there, but since when did the big console players do the sensible thing?

It will be most interesting to see if Nintendo continues its bravado approach of pretending that smartphones haven't affected the sales of the 3DS - of the 'big three', it has the most to lose.

From the various stories already written about the possible E3 launches, it seems that Sony and Microsoft care more about the threat of the second hand games market than the rise of mobile.

Yes, console games have definitely become ghetto-ised around the triple-A titles that can turn a profit, and in turn, those games now offer such a degree of longevity that consumers are buying fewer games, effectively creating a catch-22.

The Xbox rental scheme is just hire-purchase with a different name. It's a clever way to get people who don't have $300 in their pocket to buy a console. But that doesn't change anything about the gaming experience or the usage model.

I don't see the next generation of consoles shifting much at all. Hopefully we'll see disruption from the outside, with some new players trying ideas around the cloud. But all this means is that for another two to four years, iOS and Android will continue to be a huge opportunity for game developers who are disillusioned with consoles as they are today.

Thomas Nielsen, Progressive Media
In my mind, all of the console manufacturers need to reinvent their business models, fast.

Obviously the clock is ticking on the old boxed, high street games model, but I think it goes deeper. The amount of people you can get to pre-invest in an expensive 'set-top box' is going to decrease dramatically, and possibly faster than anyone thought if someone manages to disrupt the market.

And there's opportunity to do that. Onlive box. Apple TV. Not necessarily any of those specifically, but anyone else who can produce cheap hardware with clever cloud components.

The next console will be free, run games and streaming content, and the business model will be based around content purchasing.

Graeme Devine, GRL Games
I don't think there will be any more consoles. Only TV sets with the capability you mention built into them.

Oscar Clark, PapayaMobile
Do you want to build the console into the TV or to allow TVs to connect wirelessly to your devices?

I genuinely don't know the answer to that one.

John Golden, PlayPhone
I agree with Graeme - consoles will become chipsets, and content will focus on hardcore, high end games or party games. Console makers have lost their thought leadership position and social innovation.

Microsoft's subscription model is a smart, bold move in the right direction.

Eros Resmini, GREE

My prediction: tablets will become the new 'consoles', phones will become the new controllers, TVs will remain as the mega screen, PC gaming will continue to live on for the super hardcore.

Alex Bubb, Nokia
It's an irony that five years ago mobile controls were the biggest barrier to games adoption, but touch innovation broke through.

Consoles still need that 'touch' moment to bring immersive gaming to the mainstream.

That' a great opportunity though and I have no doubt it will happen. Personally, I hope for aggressive new innovation in both accessibility and immersive multi-screen experiences.

Fund managers look for tax cuts | Vietnam Business News

Fund managers are lobbying regulators for tax cuts.

Pham Dinh Thi, deputy director of the Ministry of Finance?s Tax Policy Department, said corporate income tax (CIT) reductions for the fund management industry should be considered. ?Commercial banks, the main capital mobilisation channel of Vietnam?s economy, are now subject to a CIT rate of 25 per cent. Therefore, we must study and discuss possibilities to lower taxes for fund management companies,? said Thi.

The statement was delivered at a Hanoi-based securities business tax policy conference last week where several fund managers demanded a CIT rate lower than the common 25 per cent tax rate, to stimulate the young fund management industry.

?Stock markets are usually the main capital mobilisation channel attracting 80 per cent of a society?s mobilisation capital. But that?s not the case in Vietnam where banks are the main channel for short and medium-term funds,? he said. State Securities Commission (SSC) Fund Management Department head Pham Thanh Long said a tax policy review was necessary. ?It is necessary to make tax policy changes to encourage investors to deposit in long-term investment funds, instead of speculative funds,? he said.

Long considered the new fund groups, including real estate investment funds, especially real estate investment trust (REIT) funds which mainly invest in housing and leasing, exchange traded funds (ETFs) and securities investment companies, as the new pillars of the investment fund industry, together with current pillars such as state-managed social insurance funds.

Thi said he would propose a ?specific circular? to guide securities businesses. ?It?s a rare case to have a specific circular to guide one sector. But with so many tax policy problems outstanding in the securities sector, I think a specific circular is essential.?

A representative of Vietnam Fund Management Club said according to this club?s calculations, fund investors always had to bear 5 per cent losses compared with other stock market investors due to tax policies and called for a tax reduction for this industry.

Bui Thu Thuy, head for HSBC?s Securities Services, said: ?For our international customers, Vietnam is just one of many venues for their portfolio investment and tax policy is one of many important factors for them to compare and consider investments.? ? VIR

Tom Coburn on the Debt 'Disease'

The Spectacle Blog

Sen. Tom Coburn, a doctor, utilized his medical expertise when he declared that "the country's sick" while discussing his new book, The Debt Bomb: A Bold Plan to Stop Washington from Bankrupting America at The Heritage Foundation's Bloggers Briefing on Tuesday.

His diagnosis? A dysfunctional political class right here in Washington.

More specifically, he lamented the absence of leadership in the current political arena, dominated instead by politicians who focus on the "symptoms" rather than the "real disease" and its "treatment options."

Coburn has at times been labeled a deficit hawk, but has also been a divisive figure on the right. Last year, he publicly butted heads with Grover Norquist and his anti-tax colleagues when he pushed for a plan to eliminate ethanol subsidies, which Norquist viewed as a gross violation of the advocacy group?s Taxpayer Protection Pledge, as the proposal did not offset the new government revenue with tax cuts elsewhere. Coburn argued that higher revenues are necessary to reduce the nation?s massive deficit.

"[T]here has to be some revenue component to [the tax structure], and anybody that says that?s not the case, I think they?re just wrong and they're not thinking about the long-term health of our country," Coburn had said then.

He described his new book, The Debt Bomb, as "a compilation of how we got where we are, conflict of interest in the average politician, and why they would vote for their next election rather than the best interest of the country."

As a three-time cancer survivor, Coburn is all too familiar with effective treatment options. His prescription for the nation?s debt crisis was a "very limited government," which he believed to be "the principle and the key behind our freedom." In order to attain this, Coburn called on the American citizens to demand action from their representatives.

Coburn expressed hope that "we will re-embrace [this] principle." For more on Coburn's commitment to principle, I heartily recommend this report by Andrew Ferguson.

Canada Grilled by the UN Committee Against Torture

Alex Neve. Published on May 23, 2012

A central aspect of committing to the crucial treaties that make up the world?s vital international human rights framework is the agreement of states that their record of compliance and implementation with UN treaties will be reviewed periodically by expert and independent United Nations committees.?Canada has signed on to seven of the main UN treaties, which means that those valuable review sessions come around fairly regularly.?This month it has been the turn of the UN Committee against Torture, which last took a look at Canada?s record with respect to torture prevention back in 2005.

The review is a three day process, with time slots juggled with sessions dealing with other matters on the Committee?s agenda over that same time period. It begins with an opportunity for members of the Committee to meet with interested civil society groups, such as Amnesty International, and explore and hear directly about areas of concern.?Then there is a back and forth of presentations, questions and responses between the Committee and an official government delegation, spread over two days, during which time a wide range of issues are discussed.?That has wrapped up, and I was there throughout.?We now await the final report from the Committee ? known as ?Concluding Observations? ? which constitute a set of important UN recommendations that Canada is certainly expected to take up.

No one is suggesting that there is widespread torture taking place within Canada.?There are, of course, some areas of concern on that front ? particularly with regard to unjustified or excessive police force used in response to Indigenous land and resource occupations and protests, or other mass demonstrations such as the events that played out on the streets and detention centres of Toronto during the 2010 G20 protests, or more recently in relation to the student protests in Quebec.? Excessive force ?in those circumstances may be tantamount to torture or, at least, ill-treatment (both of which are banned under international law).?The ways in which Taser guns have been used on occasion in Canada also give rise to concerns about possible torture or ill-treatment.

What is widespread, however, is the concern that Canada is ? in a multitude of ways ? complicit in torture committed by others: be that torture abroad or the failure to take adequate steps to ensure that Indigenous women are protected from the alarming levels of violence they have experienced for decades here in Canada.?Also of concern is the fact that Canada comes up short in taking the required steps to ensure that foreign torturers face justice, a key plank in the global torture-prevention agenda.

It was clear, even before arriving in Geneva for this review, but underscored by participating in and listening to the exchanges, that concerns about complicity in torture abroad so very often arise in relation to Canada?s national security laws, policies and practices.?Consider the following list of troubling issues, all of which were raised ? sometimes repeatedly ? by the Committee.

There is the fact that Canadian law (both in legislation and a 2002 Supreme Court of Canada ruling) maintains that in exceptional circumstances it is okay to deport an individual to a country where there is a serious risk that he or she will be tortured.? Most often this arises in cases where Canadian officials assert that the person concerned poses a threat to national security or public safety.? But it blatantly contravenes Canada?s obligation under the Convention against Torture ? sending someone off to a substantial risk of torture is never allowed, no matter the circumstances.

Canadian officials tried to convince the Committee that this is just a theoretical possibility, and that no one has ever been sent away from Canada facing a serious risk of torture. But the Committee was having none of that.?First, there are unfortunately a growing number of cases where it does appear that individuals deported from Canada, who argued against deportation because of concerns about torture, have in fact been tortured upon return to their countries.? In one case, the Committee had even asked Canada to hold off on the deportation to give them time to examine it more closely.?Canada refused to do so and the man was tortured in India after he was deported.?Furthermore, government lawyers spend a lot of time in court, such as in the immigration security certificate cases, forcefully arguing for deportations to go ahead despite torture concerns ? an odd legal strategy for something that is just ?theoretical?.

Canada?s notorious immigration security certificate system was also certainly a heated topic for discussion.? Numerous Committee members highlighted concerns about the fact that individuals are denied access to the bulk of the information being used against them in certificate proceedings, making it very difficult to mount a defence.? The government insisted that the introduction of Special Advocates in 2008 has addressed those concerns.?They glossed over the fact, however, that once Special Advocates have been given access to ?secret? information in government files, they are barred from communicating with the person subject to a certificate (unless they obtain an exceptional judicial order allowing them to have contact), making it almost impossible to determine the best way to challenge the information they have seen.

Canada was asked about various individual cases, particularly that of Omar Khadr and the trio of cases that were the subject of former Supreme Court of Canada Justice Frank Iacobucci?s 2008 inquiry report, Abdullah Almalki, Ahmad Abou-Elmaati and Muayyed Nureddin.? For the most part delegates tried to duck those questions, relying on the fact that those cases are currently before the courts.? What they failed to point out is that they are before the courts because the government has consistently and defiantly, for years, refused to provide redress or ensure accountability for the overseas human rights violations, including torture and ill-treatment, that all of those men have experienced, in Afghanistan, Guant?namo Bay, Syria and Egypt.?There are authoritative findings of Canadian complicity in what happened to them: in Omar Khadr?s case we see it in two Supreme Court of Canada rulings; for the other three men it is catalogued in the pages of Commissioner Iacobucci?s thorough report.?The complicity is clear.?But still, there is no redress on offer.

In total distinction to how those cases have been handled, the government was rightly commended for having?provided an official apology and compensation to Maher Arar for Canada?s role in his unlawful detention, torture and other human rights violations in the United States, Jordan and Syria.? There was concern, however, about the fact that almost six years after the Arar Inquiry wrapped up, Commissioner Dennis O?Connor?s detailed proposal for a comprehensive new model for reviewing the activities of Canadian agencies involved in national security has gone nowhere.

There also was much discussion about the Ministerial Direction to CSIS regarding intelligence information and torture that recently came to public attention through an Access to Information Request.?That Direction establishes that in exceptional circumstances involving threats to public safety, CSIS agents are free to make use of intelligence information that may have been derived through torture abroad and also that they should go ahead and share intelligence information with foreign agencies even if doing so is very likely to result in torture.? The delegation highlighted the provisions in the Ministerial Direction that very broadly require CSIS to act in compliance with Canada?s international obligations; but did not explain to the Committee how allowing intelligence information to be used in these ways complies with Canada?s unconditional obligations to prevent and punish torture under the Convention.

The Committee?s Concluding Observations should be available by the beginning of June.? But then will come the hard work of encouraging Canada to comply with what has been suggested; not Canada?s strong suit when it comes to international human rights obligations.?For instance, the Committee has twice before called on Canada to amend legislation to ensure that no one, in any circumstances, will ever be deported in the face of a substantial risk of torture.? Those previous recommendations, from 2000 and 2005, have been utterly disregarded.

PLEASE SHARE THIS ARTICLE:

One step at a time.?First we await final word from the Committee.?In addition to the national security front, concerns have been raised about violence against Indigenous women, refugee protection, the use of Tasers, corrections facilities policies with respect to such practices as segregation, justice and redress for survivors of torture, policing of Indigenous and other protests and much more.?There was also discussion about the fact that six years after Canada made a UN pledge to ?consider? signing on to an important torture prevention treaty, the Optional Protocol to the Convention against Torture ? a pledge that was repeated in 2009 ? there appears to have been very little progress towards that goal.

When we have the Committee?s report, then we must all make it clear to federal, provincial and territorial governments across Canada, that this time we expect full compliance.? Canada?s longstanding commitment to a strong international human rights system merits nothing less.

Robert Scoble Says Twitter Feels A Lot Like A Ghost Town

Google+ isn't getting a lot of fair coverage in the press, says Internet guru Robert Scoble.

While a lot of the tech press has said Google+ is a "ghost town," Scoble says it's actually Twitter's started to feel more like a ghost town.

"Seriously, I know Twitter's not a ghost town, but it sure feels like that because of the usage model there," Scoble said in a post on Google+. "As it has turned into more of an "information utility" and less of a community it feels more and more empty."

Since July of last year, he's gone from 0 to 1.5 million followers on Google Plus, and 13,000 to 261,000 followers on Facebook. But he's only gone from 240,000 followers to 260,000 followers on Twitter.

He said that's because there aren't any noise controls on Twitter, so users are getting overloaded and aren't following more people.

Here are some of the highlights of his argument over on Google+:

So, what's the new social media ghost town? I say it's Twitter. Follower growth has NOT kept up there with the other services, which is telling me something.?

1. That while number of tweets have gone up, people are getting overloaded so they aren't following more people. Why is that? Because there isn't any noise controls on Twitter (Facebook's feed, on my screens, is a LOT more useful than Twitter's feeds).

2. I'm on Google+'s suggested user list, which is gifting me a huge number of followers. But I got up to 230,000 without ever being on that list here. Lots of people are signing up and at least a few ARE sticking around here.

3. Over on Facebook there are ways to get spread around more, and juice its suggested user feature (this is one thing Facebook does better than Twitter or Google+ since this list is algorithmic and doesn't show a single same list to every user), which gets you more users.

4. Facebook juices its subscriber numbers through lists. If you get put on a list with, say, 30,000 followers, all those followers will be added to your follower count.

While all the global property gossips went ape shit over the recent news that Elin Nordegrin knocked down a twelve million dollar manse in North Palm Beach (FL), word out of Zurich?s Tages-Anzeiger newspaper?that?s in Switzerland, pansies?is that tennis titan Roger Federer dumped a substantial load of dough on a vacant parcel of land in the hoity-toity municipality of Herrliberg.

Local reports thoughtfully forwarded to Your Mama by I.M.N. Shtawd state that just before the Christian Christmas holidays Mister Federer acquired a 5,800 square meter hillside plot of vacant residential property with an unobstructed view of Lake Zurich (shown above). That?s a sizable but hardly magnanimous 1.43 acres for all us folks not on the metric system of measurements and mathematics.

The Tagi article goes on to report the value of the land in question is roughly 23,000,000 Swiss Francs which amounts to a hefty hefty hefty $24,781,800 at today?s rates according to Your Mama?s rusty but trusty currency conversion contraption. It?s not known what Mister Federer actually paid for the property and it?s also not known if the tennis king plans to develop the property for personal and private use.

Iffin Your Mama is honest?and we always are?we?d confess we don?t know exactly where Mister Federer and his wife Mirka and their twin tykes live when he?s not circling the globe, staying in customized suites at 5-star hotels, and earning tens of millions per year (even in the sunset of his stratospheric career). There are various reports that float around the interweb that Mister and Missus Federer own and/or maintain (or maintained) several homes in Switzerland that include an apartment in Oberwil outside of Basel, a penthouse pad in the tax-friendly lakeside village of Wollerau (shown above), and a ski chalet in the Swiss resort town of Valbella. The couple are also widely believed to have a luxury residence in Dubai.

The Misguided Non-cents of Real Estate 'Experts ...

A few phrases about self-proclaimed specialists on Realtors and pricing your home, specially those self-proclaimed professionals who are not Realtors or have not go through the research. Generally, in my readings, I uncover two diametrically opposed ?expert? thoughts on how Realtors price tag your house. Each cannot be suitable because they contradict each other. And as being a Real estate agent, I can let you know that both are wrong. What are these two expert views? And what is the facts? Keep reading through.

Initially, some authorities claim Realtors try to obtain your listing by telling you your house is really worth greater than it can be. This can be a bit like waving a truly massive check in front of someone?s eyes even though they signal the listing papers half-hypnotized. They?re not actually hearing something you say; they?re just viewing greenback signs. Not surprisingly, this seems like a great way to obtain a listing, but it doesn?t truly perform using this method, or if it does, it does not function extended.

The professionals state that Realtors do that and immediately commence pressuring the consumer to ?lower? the value. Properly, truthfully, if a house is not marketing, reducing the price tag will get it bought, but listing it too large to obtain the listing may possibly not be the top organization shift. Now think about this, what great can be a listing if it is actually listed at such a value that it will not offer? Just how much revenue will the Realtor make on it? I?ll let you know: none. So, else the residence ultimately sells to get a cost far beneath what the Real estate agent initially stated it absolutely was worth, or it doesn?t offer in any respect. Neither produces a happy client.

Realtors do well in business (and about 95% of all Realtors fail and stop) via an approach of referrals. That is sensible. It operates like most businesses. My spouse makes use of this analogy: no woman, time period, will ever go to a hair stylist devoid of a referral from a dependable buddy. All the marketing within the world isn?t likely to raise the stylist?s company (from ladies). Referrals drive the small business, and Genuine Estate is similar to that. Now, offered this, how quite a few referrals will a Realtor obtain from a consumer if the consumer feels the Real estate agent lied in regards to the worth of her or his property in order to obtain the listing and then constantly pressured her or him to return down on price tag? My guess is none. In all probability yours as well. So, this specialist opinion about how Realtors get listings seriously does not stand up to pragmatic business feeling. It does not operate within the extended run, for the reason that it doesn?t construct a loyal client base. So to all you ?experts?, listing above reasonable marketplace worth does not perform. It generates dissatisfied clientele, it doesn?t promote houses, it does not make revenue, it doesn?t produce referrals, and it damages a Realtor?s status.

Now, there exists a complete ?nother arranged of self-proclaimed professionals that say Realtors like to list homes Beneath industry value so that you can obtain a fast sale and make a fast buck. Duh! I presume I?m talking mainly to possible customers, so inquire oneself this? You realize ?about? what your home is well worth, and you realize what your tax value evaluation is, so would you leap at the likelihood to checklist your house for substantially below what you feel it is most likely really worth? No way. Such a method would rarely create a list for that Real estate agent. Realtors don?t get listings by underpricing the residence ? who would actually list with them? No one. In the two ?expert? opinions on Realtor pricing, this is the dumbest.

So, what do Realtors do? Nicely, they run an Equivalent Market Analysis. They try to locate a minimum of three properties (much more, if attainable) that happen to be similar to the ?subject? property (your home). Then they use this information and facts to set up an advised price tag they feel is near to honest marketplace value. Not a price tag that is as well warm, nor one that?s too chilly, but one that?s just suitable. Now, Realtors are not appraisers, and if the home is really unique, they may inquire that an appraisal be performed just before listing it, but for most houses, the Realtor is trained to acquire fairly shut to reasonable worth, though, by legislation, they?re able to not set up with certainty the fair market value of the house.

Why would a Realtor want to cost a household at what it is actually really worth? This may sound like an odd query, nevertheless it is one whose answer is fairly vital. Here are some facts made by the Nationwide Association of Realtors. On average, homes which are intially priced both drastically over or substantially beneath truthful value eventually sell below reasonable worth. Did you receive that? Houses initially priced too higher, finish up selling below honest worth! Why? Well, this is why?

It really is the law of Days on Industry, or DOM. Individuals prefer to see how long a residence is available on the market, plus the lengthier it has been available on the market, the more suspicious men and women turn out to be regarding why it has not offered? What is wrong with it? Nicely, if it had been initially overpriced, no one purchased it, because, well, it had been just overpriced. Nothing could have already been structurally incorrect with all the home, but time passes whilst it remained overpriced and as the Days on Marketplace (named DOM in the business) begins to accumulate, buyers grow to be cautious. If the situation is not corrected quickly, then no one will contact the residence for fear something is incorrect with it. Eventually the seller withdraws the listing, or is pressured to offer below honest value because the residence now features a DOM stigma. NAR (the Nationwide Association of Realtors) confirms this nationwide statistic each year making use of the numerous homes marketed over the past year.

Now, the opposite is also correct, but is genuinely pretty much pointless to go over. If a household is priced below honest marketplace worth, it?s going to market below fair industry worth. Duh! The issue is who would knowingly checklist their home significantly below truthful worth? Unless of course the seller is below duress or highly motivated for some purpose, they won?t. But if they do, it is fairly significantly a provided, listing it below fair worth will generate a product sales price tag beneath reasonable worth. But frequently talking, a lot of people won?t list their residence so low, and obtaining this kind of listings is hard (and uncommon), if not downright not possible to get a Real estate agent to complete.

So, the self-proclaimed critics of Realtors are, nicely, I detest to become so cruel, but if they are able to talk about me and my profession in such slanderous phrases, then I suppose I can return the favor: they may be idiots.

For a Realtor to survive financially and professionally, they should create a loyal consumer base. This can be paramount to good results. Overpricing homes is the quickest option to a pitiful status inside the business enterprise, to no product sales, to no customers, and also to no referrals. Underpricing homes just isn?t even achievable, as well as, I have not talked about it however, but per the Legal guidelines of Agency, it is questionable that this kind of a follow, without the consent in the vendor, is even legal. I am not an lawyer, but a true estate agent ought to location the requires from the seller over their personal demands, and knowingly underpricing a property for a speedy sale without the need of revealing for the seller its approximate fair value likely violates the Legal guidelines of Agency. Legally, at this point, I?m obligated to state that if you?d like to validate this supposition, you?ll need to talk to an attorney. I am not accredited to practice law, but I?m familiar with it, and I would be quite concerned about participating in such pricing practices.

In closing, I read a guide not too long ago that famous a research that confirmed Realtor?s personal residences bought for a higher average price compared to clientele they stand for. The authors of this study concluded that Realtors must be using an unethical benefit of their experience in pricing for this to occur. Having said that, in my experience, in greater than 90% in the listings I consider, the client desires to ?start the listing? at the best possible value (or larger) that I can remotely justify. Hardly ever does a consumer really take my suggestions on pricing their house. Offered the results from the yearly studies by NAR talked about above such a technique would result, on typical, in a sales value beneath honest value.

Realtors, about the other, do have an ?advantage in knowledge in pricing?. They realize that to obtain the highest feasible price on their home they should really initially list it at one thing very close to honest value. And they do. And guess what, the study intended to show that Realtors are not that moral really prove that if customers just followed their realtor?s advice, they too might have, overall, nationwide, higher sales prices. This impartial research just served to demonstrate which you definitely must hear a professional in relation to pricing your home, particularly if you want best dollar for it.

The research proved that realtors know the best way to get top rated greenback. They basically price it near honest market place worth. It really is odd that such information is utilised to try to show that Realtors are not ethical, when, if simply analyzed a little far more seriously, it will uncover that Realtors know precisely the best way to get leading dollar, it?s just their clientele typically don?t get their Realtor?s suggestions.

The Rewards of Conscientious Credit, or How Using a Mileage ...

May 24th, 2012

| | |

credit card

**Today?s guest post is contributed by Megan Taylor.**

My husband Ben and I recently decided to try the whole ?rewards credit card for points? thing. The idea made us a little nervous, due to our previous experiences with credit cards. But we knew the benefits could outweigh the risks, so we decided to give a rewards credit card a try. So far it?s turned out rather well. The most surprising thing was how it?s simplified my job as the manager of our money.

Our History with Credit Cards

Four years ago, Ben (then my boyfriend) and I had over $5,000 in credit card debt on three cards. I know that?s not going to win us any awards for crazy credit card debt (thank goodness), but as two 24 year olds just starting out, $5,000 was overwhelming.

The thing that gets me is how preventable (I now know) that debt was. What did we spend it on? My beater of a car broke down twice. $700. Ben?s car totaled itself (transmission died), after we?d put new tires on it. $250. I needed dental work?a lot of dental work?and my insurance only covered a third of it. $2,000. And so on. And it all went on the credit card(s). Why? Because we had no emergency fund. Heck, four years ago, I didn?t even know what an emergency fund was.

When Ben proposed and we started planning our life together, I realized that one of us needed to figure out this ?money stuff,? and nominated myself for the job. (Ben did not object; he?d rather do anything other than think about money.) Now, three years after tying the knot, we have a starter emergency fund ($1,000) and have been credit card debt free since December 2011.

Getting a Mileage Rewards Credit Card

You may be asking yourself why, after all that, we wanted a rewards credit card.

In learning how to budget our money and pay down debt (thank you, the internet), I read quite a few posts by people who didn?t think that credit was the ?epitome of evil.? Not only did they not think credit was bad, they talked about how credit could work for you, if you were able to manage it well.

Since we?d figured out how to stick to a budget and live below our means over the course of paying off our credit cards, I thought that we might be up for the temptation of having a rewards credit card at our disposal.

We talked about it, and decided that getting a mileage rewards card made a lot of sense. For one thing, Ben?s family lives in Michigan, so earning miles would mean getting to see them more often. Plus, we never did take a honeymoon after our wedding, and we would love to take a trip to England sometime in the next few years.

Having decided to get a rewards card, we chose the Venture card from Capital One. After a lot of research into the different options, the Venture card consistently came out at the top of the stack, and it?s hard to beat 2x bonus points, even if there is a $59 annual fee.

Coming up with a Solid Plan

Because of our history with credit card debt, we realized that if we didn?t have a solid plan for how we were going to use our new credit card, we?d be lost before we even began. At its very simplest, our plan is this:

We only use our credit card to buy things we would have bought anyway.

This is a very common way to approach to using credit cards wisely, but I figure if it works, why reinvent the wheel? What this plan means for us is that we primarily use our rewards credit card on three of our budget categories: Gas, Groceries, and Miscellaneous Needs (which covers every-so-often purchases like haircuts or a new mop).

The only other types of purchases we decided we would use our credit card for is online purchases (for security reasons) and things we?ve been saving up for. The latter covers things like plane tickets, a celebratory dinner out, etc. The rule here: If we don?t have the savings to cover it, we can?t buy it.

Paying It Off (Weekly)

I find that paying off our card weekly helps ease my mind by making sure that we?re on track with our budget. Otherwise, I worry that we?ll get to the end of the month and our spending will be wildly out of control.

At the end of each week, I make three payments to our credit card: one for Gas purchases, one for Grocery purchases and one for Miscellaneous/Expected purchases. The three separate payments help me to track how much we?re spending in each category.

This is how having this credit card actually simplified my money management efforts. I used to obsessively record and categorize each purchase, but not consistently, so it would take hours to reconcile our accounts at the end of the month.

Now, I?m effectively reconciling our credit card purchases every day, and putting our spending in those three Needs categories has greatly reduced the number of checking account transactions I have to reconcile each month, saving me a lot of time.

Proceeding with Caution

Credit cards can be a great tool, if you can use them wisely. I would never have considered opening a credit card for the rewards points even a year ago. I was feeling too overwhelmed with our credit card debt situation, and wasn?t sure we wouldn?t spend too much.

The key to avoiding credit card debt was figuring out our credit weakness (in our case it was large, unexpected expenditures?i.e., emergencies) and how to avoid spending on said weakness. Now that we have an emergency fund, that?s less of a concern.

We?re proceeding with caution, but things are going well so far. We?ve earned 18,700 points and are using those points to visit Ben?s family in August.

Tameka Foster Attorney to Usher: Did You Bang a Bridesmaid?

Welcome to The Real Housewives of Amazing Six Packs.

In court once again this morning to testify in the custody hearing brought on by ex-wife Tameka Foster, Usher was grilled about an incident from a couple years ago when Foster reportedly spit on Usher and sort of threatened his life.

Did Usher provoke this attack by cursing off his ex? No, the artist insisted over and over against allegations made by the attorney.

From there, meanwhile, things got really weird, as the same lawyer questioned Usher about his relationship with Maya Fox Davis, one of Tameka's bridesmaids from their wedding. She asked if the singer was caught "in bed" with Davis, at which point his attorney objected, claiming irrelevancy to the custody case.

Usher, to his credit, handled himself as well on the stand as he handles himself on the dance floor, remaining calm and under control, with the exception of yesterday's tears.

The trial is now in recess and will continue in July.

Virtual Assistants- Help Internet Marketers Grow Their Business

If you are an internet marketer and running an online business, you would definitely require virtual assistants to work for you. These professionals are becoming a great choice these days in handling daily tasks and administrative support tasks.

Virtual professionals perform all the activities sitting in their homes or offices rather than yours. Thanks to the advance technology, you can easily contact a virtual professional through phone, email, fax or telephone, postal mail or courier service. Further, you won?t have to provide any office equipment and facilities to them. The ease of hiring them on an hourly basis, project basis or monthly retainer basis makes it more comfortable for business owners to prefer them.

There are several types of virtual assistants which can be hired by a business owner-

Virtual personal assistant- this person is very efficient in managing your daily tasks quite efficiently.

Tasks like attending calls, preparing business notes, fixing meetings setting reminders, setting contact preferences etc. seems to be small but are very crucial.

Virtual administrative assistant- this person plays different roles by handling business presentations, client meetings, event planning, document processing, following up with customers and suppliers etc.

Virtual executive assistant- your personal executive will support you in taking care of your small projects, checking invoices, database management, bookkeeping services and many more.

Virtual marketing assistants- wanting to promote a product, praising a brand, promotion through newsletters, journals or any other means, this virtual person would help you.

Virtual data entry assistant- data entry is a very important area of the business and there are professionals who give you unerring and fast data entry services.

All virtual assistants are available at different rates. When you are hiring them, keep in mind that you need to bring your company to a particular financial level. So, be wise and choose a person who has top notch skills, nice working attitude and a willingness to do things according to your way.

The best part is that your virtual administrative assistant is never far from you. Just a phone call, message or email and he/she is there for you. With a virtual professional you share several confidential things and he takes care of it very well. Don?t worry about your internet marketing secrets, he understands their importance and keep them safe.

Hiring these employees is a great idea in these tough and competitive times. This way, you can focus on the strategic growth of the business and work on bottom line functions. While hiring keep in mind that you approach a reliable company which have years of experience and has a good and proficient team. In my view, individual virtual assistants are not that efficient.

Believe me, your personal assistants are the reliable and loyal business partner with you.?
